Terms and Conditions

Last updated: please check the date shown on this page each time you use the service.

These Terms and Conditions ("Terms") govern your use of the Kemivi website and the Kemivi mobile application for personal finance management (together, the "Service"). Please read them carefully before you subscribe or use the Service. By placing an order or using the Service, you agree to be bound by these Terms.

1. Who We Are and How to Contact Us

The Service is provided by Kemivi ("we", "us", "our").

You may contact us using any of the details above for questions about these Terms, your order, your account or a complaint. We aim to reply to all enquiries within a reasonable time.

2. Our Service

Kemivi offers a mobile application designed to help people, and in particular pensioners, to organise and understand their personal finances, for example by recording income and outgoings, planning budgets and keeping track of regular payments. The Service is a budgeting and organisational tool. It does not provide regulated financial, investment, tax, legal or pension advice, and nothing in the Service should be treated as such. You remain responsible for your own financial decisions.

3. Eligibility and Your Account

4. How an Order Is Placed and Confirmed

You may place an order through our website or the application by following the on-screen steps. The process works as follows:

  1. You select the plan or option you wish to purchase.
  2. You review your order, including the price, before submitting it, and you may correct any input errors at that stage.
  3. You submit your order and complete payment where payment is required.
  4. We send a confirmation to the email address you provided. The contract between you and Kemivi is formed when we send that confirmation and make the Service available to you.

If we are unable to accept your order, for example because of a pricing error or a problem with payment, we will tell you and will not charge you, or we will refund any amount already taken.

5. Prices, Payment and What Is Included

All prices are shown in pounds sterling (GBP) and, where applicable, include VAT at the prevailing rate. The price payable is the price displayed at the time you place your order.

6. Your Right to Cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer you generally have the right to cancel a contract for digital content or services within 14 days of the contract being made, without giving a reason.

Nothing in this section affects your statutory rights under the Consumer Rights Act 2015, including where digital content is not of satisfactory quality, is not fit for purpose or is not as described.

7. Complaints

If you are unhappy with the Service, please let us know so that we can put things right.

  1. Contact us at [email protected] or on +44 161 917 5588, giving your name, the email address linked to your account and details of the problem.
  2. We will acknowledge your complaint promptly and aim to provide a full response within 14 days. If we need longer, we will tell you why and when to expect an answer.
  3. If we cannot resolve the matter, you may consider alternative dispute resolution. We will tell you if we are willing to take part. You also remain free to bring a claim in the courts.

8. Acceptable Use

You agree not to misuse the Service. In particular, you must not attempt to gain unauthorised access to our systems or other users' data, interfere with the operation of the application, copy or reverse engineer it except as the law permits, or use it for any unlawful purpose.

9. Intellectual Property

The application, website, text, graphics, software and all related intellectual property belong to Kemivi or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the application for your personal, non-commercial use for as long as your contract continues. You keep ownership of the financial information you enter.

10. Personal Data, Cookies and Your Rights

We handle personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. We act as the data controller for the personal data you provide to us.

Where processing relies on your consent, you may withdraw it at any time. To exercise any of these rights, email us at [email protected] and we will respond within one month. If you are not satisfied with our response, you have the right to complain to the Information Commissioner's Office, the UK supervisory authority for data protection.

11. Availability and Changes to the Service

We aim to keep the Service available and working well, but we do not promise uninterrupted or error-free access. We may carry out maintenance, update features or make changes to improve the Service. If we make a significant change that negatively affects you, we will tell you and, where appropriate, you may cancel and receive a refund for the unused part of any period you have paid for.

12. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded, including your statutory rights as a consumer.

Subject to the above:

13. Events Outside Our Control

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including failures of third-party networks or utilities, severe weather or industrial action. We will tell you as soon as reasonably possible if such an event affects the Service.

14. Ending the Contract

You may stop using the Service at any time, subject to Section 6. We may suspend or end your access if you seriously or repeatedly breach these Terms, and we will explain our reasons. If we end your access other than for your breach, we will refund any amount you have paid for the period after termination.
